Personal Injury Law

- A driver of a car or truck turning around

   to talk to their kids and driving;

- A driver of a car or truck turning without signaling the turn;

- A driver of a car or truck turning at the last minute to beat a light;

- A driver of a car or truck running a “yellow” light;

- A driver of a car or truck not keeping a proper look out;

- A driver of a car or truck missing stop signs and yield signs; or

- A driver of a car or truck driving too fast for the conditions at the time.

All of these acts are decisions and choices made by unsafe drivers that cause automobile and truck collisions in Arkansas every day.  This means, due to the unsafe and dangerous choices made by poor drivers, motor vehicle collision injuries happen many times every day.  These unsafe drivers put all other Arkansans at risk of being needlessly injured or killed by these types of drivers.

Merriam-Webster’s Dictionary defines an “accident” as an unforeseen event.  A driver’s choice to operate a motor vehicle or truck unsafely produces foreseeable consequences of injuries or death on Arkansas Roads every day.  These 28,631 fatal and non-fatal injuries are not “accidents” which are unforeseeable or unpreventable.  The collisions which caused these injuries are a result of unsafe choices by negligent drivers.

The person who has this harm imposed upon them by these unsafe drivers should not be burdened with the medical bills, lost wages and suffering from the pain caused by these injuries from unsafe choices made by another driver.

The Arkansas State Police Driver License Study Guide warns new drivers that:

“Drivers must be alert to what is going on around them. Many accidents occur because drivers do not pay enough attention.”

“The single biggest contributor to accidents is failing to see what is about to happen.”

“If you have a cellular phone or CB radio, avoid using it when the vehicle is in motion.  Even with “hands free” equipment, conversing on a phone or radio takes your attention away from driving and can cause you to be less likely to notice hazardous situations.”

“To be a good driver, you must know what is happening around your vehicle. You must look ahead, to the sides, and behind the vehicle.”

“You must warn other drivers you are going to change direction or slow. This will give them time to react, if needed, or at least not to be surprised by what you do.”
